    ORDER OF THE BOARD (by C.A. Manning):
    On September 1, 2000, the Illinois Environmental Protection Agency (Agency) filed a rulemaking proposal
    pursuant to Section 8 of the Groundwater Protection Act and Section 27 of the Environmental Protection Act (Act)
    (415 ILCS 5/27) (1998)) to establish groundwater quality standards for the contaminant methyl tertiary-butyl ether
    (MTBE). The proposal would set preventive response level standards of 0.020 mg/l and groundwater quality
    standards of 0.070 mg/l for Class I and Class II groundwaters. The proposal would also amend 35 Ill. Adm. Code
    620.505 “compliance determinations” to include specification of conditions when drinking water supply wells can be
    used for such determinations, in addition to various other changes. The Agency requests that the Board adopt these
    proposed rules “as expeditiously as practicable.”
    The Board finds that the petition meets the minimum requirements of 35 Ill. Adm. Code 102.160(a) and
    accordingly accepts this proposal for hearing. We hereby direct the hearing officer assigned to this matter to
    schedule hearings as required pursuant to Title VII of the Act.
