HEARING OFFICER ORDER
Hearing Cancellation
As determined during the hearing on September 11, 2000, the previously scheduled hearing for Friday, September 22, 2000, in Chicago, is hereby canceled. The September 22, 2000 hearing was originally scheduled if needed for additional substantive testimony on the Board’s first notice opinion and order in the above-referenced matters. The Board has determined that the additional day of hearing is not necessary and no members of the public or regulated community have requested that the hearing be held.
The deadline for submission of written public comments is Monday, October 23, 2000. Filing of written public comments should be in accordance with previous hearing officer orders issued in these matters.
Submission of Report for Agency Review
During the hearing on September 11, 2000, the Board questioned Gary King, a witness from the Illinois Environmental Protection Agency (Agency), regarding the findings of a report prepared by the National Research Council, Committee on the Remediation of Buried and Tank Wastes.
The Board’s technical unit requested that Agency witness King review and comment on this report in the context of the Agency proposal in R00-19(A), involving the use of environmental land use controls or “ELUCs.” With this hearing officer order, we are again requesting that the Agency review this report and provide written comments, within the written comment period. Due to its volume, hard copies of this report are not being provided to the notice and service lists. While the Board is specifically requesting comments on this report from the Agency, comments from any other interested person are also welcome.
